Your booking is made with Violet & Kenneth Norman and Philip Allsopp trading as Eden House Country Guest Accommodation ("Eden House") and represents a legally binding contract between you and Eden House.
1. General
a) The person who makes the booking will be accepting the terms and conditions on behalf of the whole party being accommodated. It is this person’s responsibility to ensure that all members of the party are aware of and accept the whole of these terms and conditions and the obligations contained in them, the leaflet and any other documents and information supplied by us.
b) Please note that a contract is not made until acceptance of the booking by Eden House issuing a written Booking Confirmation.
c) Our agreement incorporates the entire contents of the current website, the Booking Confirmation and in particular the General Information and Conditions of Booking (our agreement). You must also note and comply with all reasonable guidance given by us.
d) Our agreement is governed by the law as it relates to England and Wales and we agree to the non exclusive jurisdiction of the English and Welsh Courts. We must both act reasonably in selecting or agreeing any jurisdiction including any forum for dispute.
e) Should any part of our agreement by deemed by law to be void, the remainder of the agreement will, if capable, continue in full force and effect.
f) Please note we accept no liability for loss or damage to your possessions unless due to our negligence.
g) All bookings are subject to availability. Please note the current website supersedes all previous editions and any guidance we may have communicated to you.
2. Smoking
All bedrooms are non-smoking, as are all the rooms in the main house and other buildings. Any bedrooms tainted by residual tobacco odours will be specially cleaned and aired over a 24-hour period and all charges resulting from this, both actual and loss of business (at prevailing B&B rates) will be charged to the account of the person in whose name the booking was made. Please take note: It is now against the law to smoke anywhere on these premises (The Smoke-free Premises (Wales) Regulations 2007).
3. Age Restrictions
For reasons of safety, children may not occupy a bedroom overnight unless accompanied by an adult; therefore our holidays, breaks and facilities are tailored to people over the age of 16 years. Accordingly we reserve the right to decline entry to persons below that age unless agreed specifically by us in writing before arrival. We have no family room.
4. Single Occupancy
The tariff is levied as a room rate; therefore the single occupancy of a bedroom is charged at that of a double.
5. Single Nights
We require a minimum 2-night stay, particularly at weekends and during public holiday periods. We are, therefore, unable to accept bookings of less than 2 nights’ duration.
6. Brochure / Website Prices
We guarantee that the price of your break will be as agreed and shown on your Booking Confirmation for your party size, and for the accommodation you choose and all items described as included in the cost of your break, save that we reserve the right to amend prices where there is an increase in any tax, fee or levy applicable to your break. We reserve the right to raise or lower our prices at any time before booking, whether via a subsequent brochure or any other communication.
7. Cancellation following non arrival
If you have not arrived by 7:00 pm the evening of the day your break was due to commence, or contacted Eden House to confirm when you will arrive (the time of which must be mutually agreeable), we will assume that the break is cancelled. A cancellation charge of at least 50% of the total value of the booking as detailed in the Booking Confirmation will then be charged. For bookings of 2 rooms or more, and/or 2 nights or more, and/or special events and public holidays, we require a minimum of 14 days notice of cancellation or amendment of any reservation to avoid a cancellation charge of at least 50% of the total value of the booking as detailed in the Booking Confirmation. However, the charge MAY be waived in part if we are able to re-let the cancelled room(s) in part, and WILL be waived in full if the total value of the booking can be replaced in full. Guests who do not arrive to take up their booking and have not given notice of cancellation will be invoiced for the full cost of the accommodation booked.
7. Pets
Regretfully, we are unable to accommodate guests’ pets at Eden House under any circumstances.
8. If we cancel or change your break
If we cancel your break or make any significant alterations such as changing your date of arrival or duration, then (provided such cancellation or changes have not arisen from circumstances beyond our control) you have a choice of:
a) a replacement break of a standard comparable to that booked and of the same value, or
b) a replacement break of lesser value together with a payment from us to you of the difference in price between the replacement break and the break booked, or
c) a replacement break of higher value with a payment of the difference in price between the original break and subsequent break payable to us, or
d) a full refund.
9. Limitation of Liability
We accept responsibility for those arrangements for your break that are within our control, but we cannot accept liability for any injury, loss or damage suffered by you or any member of your party, unless one of the following applies:
1. there was wilful default by us, our employees or agents; or
2. death or personal injury was caused by the negligence of us, our employees or agents.
For all claims other than death or personal injury, which result from the non-performance or improper performance of the contract by Eden House, we will pay compensation that is reasonable in all circumstances.
If you have a complaint or comment you are asked to notify any shortcoming or complaint you may feel has occurred to the proprietor at Eden House as soon as possible so that wherever possible it can be remedied for you at the time. Any reported matter which has not been resolved during your break should be advised in writing to the proprietors at Eden House as soon as possible to enable us to carry out an investigation. Claims may be reduced or rejected if we have not been given the opportunity to put matters right whilst you are on your holiday or break.
10. Special Requests
We cannot guarantee to meet all special requirements you may have, however if we know about them in advance we will try to do so.
11. Confirmation of Booking
Once the booking is confirmed we will send the lead name on the booking a Booking Confirmation letter, which will include details of the cost of your holiday or break. A contract will be in place once your booking has been confirmed to you in writing. If any information contained in the Booking Confirmation letter is incorrect, or subsequently becomes incorrect, please telephone the proprietors at Eden House immediately.
12. Safety Policy for Guests with Disabilities
Your safety is our concern. All rooms are fitted with an electronic smoke alarm. If you or any member of your party is unable to hear a fire or smoke alarm then please advise us at the time you make the booking.
13. Care of Facilities and Accommodation
We like to keep the rooms and accommodation in our home in good condition and require that you treat them with respect and care so that other guests may continue to enjoy them. In the event that you notice damage to any facility or in your bedroom, please report it to the proprietors immediately so that we can arrange any necessary repairs. Accommodation will be checked at the end of your holiday, and you may be charged for any loss or damage found. Please note guests are requested to not take cooked food, either from the dining room or as ‘take-away’ meals, into the bedrooms. Food stains on duvets and carpets can be both expensive and difficult to remove. We reserve the right to enter accommodation when reasonable to do so.
14. Special Dietary Requirements
We regret that we are not able to accommodate any person(s) with a serious and/or life-threatening nut or food allergy as we cannot guarantee the provenance of every item of food in our kitchen. The breakfast provided includes vegetarian options. Should anyone in your party have any other dietary requirements, please let us know when you book your break so we can endeavour where reasonably possible to assist. Any special request must be agreed at the time of booking and confirmed prior to arrival.
15. Infections or Contagious Diseases
If any member of your party has, or has just had, an infection or contagious medical condition, we reserve the right to:
• refuse to accept your booking
• cancel your holiday or break; or
• ask any member of your party to be confined to their room or leave Eden House immediately, should we, at our reasonable discretion, consider it necessary to protect the health of other guests, staff or the general public.
You should inform us immediately should any such condition develop in any member of your party within one week of your arrival date or during your holiday.
16. Day Guest Visitors
Guests can visit you while you are on a break, but please note the legal requirement that only the people named on the booking may stay overnight on the premises, otherwise your booking will be in breach of your contract and you and they may be asked to leave. No refund is payable in these circumstances. Permission must be sought from the proprietors first.
17. Unreasonable Behaviour
We reserve the right to terminate a holiday or break without compensation, where we believe that the behaviour of any of the persons named on the relevant booking or their guests might impair the enjoyment, comfort, health or safety of other guests, our staff, proprietors or the public. Guests must not bring to, or use at, Eden House any firearm, fireworks, illegal substances, offensive weapons or hazardous chemicals or any similar item.
18. Compensation Payable by You. We reserve the right to recover from you, either via the credit/charge card used to pay for the holiday or otherwise, the costs of any damage caused by you or your party, or compensation we pay including to any other guest. This includes the replacement, cleaning or repair of any item(s) belonging to Eden House or the fabric of the establishment itself, damaged either wilfully or because reasonable precautions have not been taken.
19. Brochure / Website Accuracy
We take care to ensure that at the time of going to press the details in any brochure, leaflet, website or other communication produced by us, were accurate regarding the description and information about facilities available, or were planned to be available at Eden House. Our photographs are intended for guidance only, and are generally representative of the rooms, grounds and facilities available. We try to ensure that the website and other publications have all the information you need to book the right holiday or break for you, and should you have any queries or special requirements not covered, please ring the proprietors on 01239 841499 during office hours.

20. Data Protection Policy Statement
Eden House will use the personal information that you provide to us to process your booking and provide you with your holiday or break. We may need to pass your information to third party service providers relevant to meet our obligations to you, for example where you have requested additional services and/or facilities and they are provided by third parties. Eden House will also use your information for internal statistical, market research and records purposes. Your information may also be used to send you details of other services or special offers. If you do not wish to receive such information please inform us at the time of receiving your Booking Confirmation.
